1. Educational Purposes Only

All products and services provided by Review Pulse ABN 29 8961 99335 (“we,” or “us” or "our"), including but not limited to online and in person courses and training sessions, informative communications, website development and functionality, and communication, training, and/or marketing systems, are designed for educational and informational purposes only. No information, strategies, systems, or tools should be interpreted as a promise or guarantee of specific outcomes, results, or earnings.

2. Course Access Duration

All online courses provided by us are accessible for 90 days from the date of purchase unless otherwise specified. After this period, access to course materials will expire, and re-enrolment may be required to regain access. Sharing login credentials with others is strictly prohibited and may result in account suspension or termination without a refund. If you require extended access, upgrade options may be available. Please refer to our course upgrade options if applicable or contact us for more details.

3. Methods of Payment

By choosing a payment plan or ongoing subscription, you give us permission to charge the credit or debit card we have on file for any ongoing SaaS or loyalty card program subscription fees or other amounts you owe, according to the agreed terms. If your payment method is declined, you’ll need to provide a valid one promptly to avoid losing access to your service or program. If you’re on a payment plan, you agree to complete all remaining payments unless you request a refund within the allowed time frame. You also agree that we may automatically charge any valid payment method on your account to recover unpaid fees, without additional notice unless the law requires it.

4. Service Fees

Certain features of our platform—such as email services, SMS messaging, AI-driven posting tools, and text-compliant phone rentals—incur charges from external providers. If these costs are billed to you they are done so at the same rate we receive from our providers, with no additional markup or profit added. All such fees are passed on at cost to ensure transparency and fairness. Details of applicable charges will be provided during the service agreement or subscription process.

5. Use of Communication, Software, and Marketing Systems

Our communication, software, and marketing systems, including but not limited to free websites, missed call text-back systems, reputation management systems and tools, AI-powered messaging, loyalty card programs, and automated social media communication platforms, are provided as-is. All intellectual property remains the exclusive property of Review Pulse and its third-party providers. Ownership is not transferred and may not be reproduced, distributed, or used without prior written consent. The client is granted a limited, non-transferable license to use the website, digital tools, and associated services during the term of this agreement solely for their business purposes. While we provide guidance for implementation, we cannot guarantee specific outcomes such as accuracy, increased customer engagement, improved search engine ranking, reputation, or revenue . Users are responsible for ensuring that they have consent to communicate with and market to their customers, and for ensuring that they are in compliance with all applicable laws and regulations when using these systems, tools and services, and for checking and ensuring that they are operating as intended.

6. Satisfaction Guarantee and Refunds

Your satisfaction is our priority. If, within 30 days of purchase, you are dissatisfied with the quality of our training or product, you may request a full refund by contacting us directly. You can cancel your subscription to our software at any time by giving us 30 days’ notice. If you’re on an annual plan and have paid upfront, we still require at least 30 days’ notice before the end of your current annual term to stop it from renewing. Please note that we do not offer refunds on annual upfront payments if more than 30 days have passed since the start of your plan. Refund requests must be submitted in writing, and we reserve the right to verify eligibility. Marketing systems that require third-party subscriptions or integrations are subject to the refund policies of those third parties. Standard updates — like changing text, updating images, or refreshing content — are billed at AUD$25 per 15 minutes or part thereof.

7. No Guarantee of Results

While we are committed to delivering high-quality information, strategies, systems and tools, we do not guarantee or assure any specific outcomes, financial gains, or results from using our products and services. Any financial figures or examples mentioned are for illustrative purposes only and should not be taken as typical, guaranteed, or expected results. The results shared by Review Pulse are based on personal and/or client experiences and are not guaranteed or typical. Success in any business venture requires significant effort, experience, and dedication. Individual results will vary based on numerous factors including, but not limited to, external economic, competitive, and financial factors, your background, experience, and work ethic. All business activity involves risk.

8. No Professional Advice

The information and tools provided do not constitute legal, medical, tax, business, financial, or other professional advice. For specific advice tailored to your situation, please consult a qualified professional such as a lawyer, accountant, counsellor, appropriate medical practitioner, business coach, or financial advisor.

9. Personal Responsibility

Your decisions, actions, and results are your responsibility. By purchasing or using our products and services, you acknowledge and agree that Review Pulse is not responsible or liable for any decisions or actions you take based on the information provided.

10. Disclosure to Third Parties

To provide you with our services, including but not limited to loyalty programs, digital rewards, and subscription billing, we may share your personal information (including name, email address, and billing information) with trusted third-party service providers, such as payment processors and software platforms (e.g., Stripe etc). We only disclose information necessary to fulfil the service you’ve requested and ensure your transactions are completed securely and efficiently. By using our services, you consent to the sharing of your information with such third parties solely for the purpose of fulfilling and supporting your transactions and customer experience. You acknowledge that: You are aware that third-party platforms may be involved in processing your data and payments; You accept the risks associated with such third-party involvement; You agree that you will not hold Review Pulse liable for any indirect or consequential loss relating to third-party service failures.

11. Limitation of Liability

To the maximum extent permitted by law, Review Pulse and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from the use of our products and services. While we take reasonable steps to select reputable service providers and maintain data security, we do not control how third-party platforms manage or secure your data once it is transferred. Accordingly, you agree that Review Pulse is not liable for any loss, damage, or unauthorised transactions that result from the actions or in-actions of such third parties, including but not limited to delays, overcharges, system errors, or breaches. By engaging with our services, you agree to indemnify and hold harmless Review Pulse, its directors, employees, and agents from any claims, losses, or liabilities arising from the use of third-party services that are required to deliver the products or services you’ve purchased.

12. Loyalty Reward Card Terms of Use

By using our digital loyalty reward card services, you (the Client) agree to the following terms:

Ownership and Responsibility: You retain full responsibility for how your business uses the digital loyalty cards, including how and when rewards are issued, how customers are informed, and any promotional offers linked to the cards.

Compliance: You agree to use the loyalty program in compliance with all applicable laws, including any local consumer or privacy regulations. We are not liable for how you choose to run or promote your reward offers.

Customer Data: If customer contact details (e.g., phone numbers or emails) are collected through the loyalty system, you are responsible for obtaining any necessary permissions and ensuring data is handled in line with privacy requirements.

Service Limitations: We provide the digital platform to support your loyalty program, but we do not guarantee specific results such as increased customer retention or sales. The success of your loyalty program depends on how you implement and promote it.

Modifications and Cancellations: You are responsible for notifying your customers of any changes to the reward structure or discontinuation of the program. We will provide the tools to help you manage the system but do not communicate directly with your customers on your behalf.

13. Governing Law

These terms and conditions are governed by the laws of Queensland, Australia. Even if other legal rules might suggest using another state or country’s laws, only Queensland law will apply. By purchasing or using our products and services, you agree to submit to the exclusive jurisdiction of the courts in Queensland, Australia.

14. Amendments to Terms

We reserve the right to update or modify these terms and conditions at any time. Any changes will be posted on our website https://reviewpulse.com.au/terms-and-conditions, and it is your responsibility to review them periodically.
